Kurt Busch to appear in Del. court tomorrow
Attorney James Liguori told The News Journal (Wilmington, Del.) that Busch must report to the Kent County Family Court by 9 a.m. local time and that his hearing is one of 11 total hearings at the court tomorrow.
Busch's hearing was originally scheduled for Dec. 2, but it was postponed as he would be returning to the U.S. on that day after competing in Italy.
Early in November, Busch's ex-girlfriend, Patricia Driscoll, alleged in court documents that Busch had attacked her inside his motorhome at Dover International Speedway on Sept. 26.
Busch has since met with the Dover (Del.) Police Department to address the allegations. The department's investigation remains ongoing at this time but a spokesman for the department said in an e-mail to the News Journal that the investigation has been hampered by both the delayed reporting of the incident and frequent travel for some of the witnesses.
Driscoll's own attorney has said that a custody battle between her and her ex-husband over their son was the reason why she did not immediately contact authorities.
"As any parent will tell you, their child is their primary concern," attorney Mark Dysio said in a Nov. 8 USA Today story. "So legally, it took some time to work through the process of how Mr. Busch's situation with Ms. Driscoll would affect that custody case. It was only until that was resolved to a certain degree of satisfaction that we were able to pursue the second avenue." NBC Sports
