Lawsuit against Stewart still moving forward

A required mediation session is set for April 18 in the wrongful death lawsuit filed by the parents of Kevin Ward Jr. against Tony Stewart, according to a court filing Thursday. The Ward family has asked for unspecified damages against Stewart, who was not indicted by a grand jury, and has said in court documents he didn't see Ward until just before Ward, on foot, attempted to make contact with his car during an Empire Super Sprints race Aug. 9, 2014 at Canandaigua (NY) Motorsports Park.
Stewart's court filings show Ward's toxicology report indicates Ward used marijuana within five hours of the race. Also Thursday, Stewart's appeal was officially withdrawn in a related case, where a federal judge ruled that Stewart's insurance company does not have to cover any legal fees or settlements because ESS races were not listed among the series in his policy.
