Mosley loses battle in Court of Rights

Former FIA President Max Mosley has lost a case against newspapers publishing articles on private lives before informing the subject. The European Court of Human Rights has dismissed the matter, which follows Mosley’s infamous scandal of 2008.

Son of British fascist Oswald Mosley, the then FIA President had been secretly filmed before details of his sex life were published by The News Of The World, with parts of the story being true whereas others – notably that activities taking place had been of a Nazi theme – were not.

If today's case was successful, newspapers would have been forced by law to inform the subjects of such stories before publishing articles.

The Strasbourg-based Court has issued the following statement:

‘The court is of the view that article 8 does not require a legally binding pre-notification requirement. Accordingly, the court concludes that there has been no violation of article 8 of the convention by the absence of such a requirement in domestic law.’
